Import Inspection of Chemicals Controlled for Environmental Protection (PSD: 2026/6)

The Import Inspection of Chemicals Controlled for Environmental Protection Communique, designated as Product Safety and Inspection: 2026/6 and published in the Official Gazette on December 31, 2025, has brought the import of substances, mixtures, and articles listed in Annex 1/A, Annex 1/B, Annex 1/C, Annex 2, Annex 3/A, and Annex 3/B of the Communique within the scope of environmental conformity inspection. This regulation will apply to import procedures carried out under the Free Circulation Entry Regime as well as the Inward Processing Regime, Processing under Customs Control Regime, and Temporary Import Regime.

Under the Communique, it has been regulated that imports of certain substances and certain articles containing or working with these substances are prohibited, while for certain other products, imports may only be carried out after the relevant control certificate or conformity process has been completed. For this reason, it is important to correctly identify the HS Code of the product and check whether it appears in the annex lists before commencing import procedures.

The product groups within the scope of the Communique are generally assessed under the following headings: chemicals and articles within the scope of ozone depleting substances, fluorinated greenhouse gases and hydrofluorocarbons, substances and mixtures listed in the annex lists, and certain article groups defined in the annex lists.

In the conformity inspection process, a control certificate may be required depending on the product group for the import to be completed. For ozone depleting substances, an ODS Control Certificate may be issued, while for fluorinated greenhouse gases and hydrofluorocarbons, the relevant control certificate may be generated following applications submitted through the system. These documents will be presented to the relevant customs administration at the time of customs declaration registration.

In control certificate application processes, documents such as an application form, proforma invoice or invoice, analysis certificate, labeling information, and payment receipt may generally be requested. Additional information and documents may also be required depending on the nature of the product, its intended use, or the method of importation. To avoid delays in the import process, it is recommended that applications be completed on time when shipment planning is being carried out.

With this Communique, the previous regulation PSD: 2025/6 has been repealed. The new regulation enters into force on January 1, 2026, and companies intending to import are required to act in accordance with the lists contained in the annexes of the Communique.
