The Import Inspection of Solid Fuels Controlled for Environmental Protection Communique, designated as Product Safety and Inspection: 2026/7 and published in the Official Gazette on December 31, 2025, regulates the procedures and principles relating to environmental conformity inspection for imports of solid fuels listed in Annex 1 of the Communique. The Communique will apply to import procedures for solid fuels within the scope of Annex 1 that will be subject to the Free Circulation Entry Regime.
According to the Communique, imports of solid fuels listed in Annex 1 may only be carried out by companies holding a Solid Fuel Importer Registration Certificate obtained from the Ministry of Environment, Urbanization and Climate Change. Registration certificate applications are submitted through the Ministry's relevant application, and documents such as a trade registry or chamber registration certificate, tax certificate, and undertaking may be requested as part of the application.
In the conformity inspection process, the essential steps are sampling from the fuel subject to import, laboratory analysis, and issuance of an Imported Solid Fuel Conformity Certificate based on the analysis result. If the analysis result is found to be non-compliant, a Non-Conformity Letter is issued and import of the non-compliant fuel is not permitted. In such cases, the fuel may need to be returned to the country of origin or loading, or forwarded to a third country.
The Communique also includes a mechanism for objecting to analysis results. If a request is made within the specified period in the event of a non-compliant analysis result, witness sample analyses may be carried out and a final conformity or non-conformity decision is issued. In certain situations such as use for industrial purposes or for thermal power plants, it may be possible to issue a conformity certificate under specific conditions.
With this Communique, the previous regulation PSD: 2025/7 has been repealed. The new regulation enters into force on January 1, 2026, and provision has been made within the transition process for the previous communique provisions to apply for a certain period for imports of fuels meeting specific conditions.
Examples of products within the scope of Annex 1 include solid fuel types such as anthracite, bituminous coal, lignite, coke and semi-coke varieties, and petroleum coke.
